GENERAL CONDITIONS OF SALE

These conditions of sale are concluded on the one hand by the Company Mon Make Up, under the name Mon Make Up registered in the trade and companies register of Annecy, hereinafter referred to as "Mon Make Up" and on the other hand, by any natural or legal person wishing to make a purchase via the website of "Mon Make Up" hereinafter referred to as "the buyer".

Object

These conditions of sale aim to define the contractual relations between Mon Make Up and the buyer and the conditions applicable to any purchase made through the Mon Make Up merchant site, whether the buyer is a professional or an individual.
The acquisition of a good and/or a service through this site implies unreserved acceptance by the buyer of these conditions of sale.
Mon Make Up reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.

Characteristics of the goods and services offered

The products and services offered are those listed in the catalog published on the Mon Make Up website. These products and services are offered while stocks last.
The photographs in the catalog are as faithful as possible but cannot ensure perfect similarity with the product offered, particularly with regard to colors.

Rates

The prices listed in the catalog are inclusive of all taxes in euros, taking into account the VAT applicable on the day of the order; any change in the rate may be reflected in the price of the products or services.
Mon Make Up reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer.
The prices indicated in the catalog do not include order processing, transport and delivery costs. The delivery price is automatically added and indicated during the order finalization phase.

Orders

The buyer, who wishes to purchase a product or service, must:

• Register a valid phone number
• Fill out the identification form on which he will indicate all the contact details
• Validate your order after checking it
• Make payment under the conditions provided

Confirmation of the order entails acceptance of these conditions of sale, recognition of having full knowledge of them and the waiver of relying on one's own conditions of purchase or other conditions.
All data provided and the recorded confirmation will constitute proof of the transaction. The confirmation will constitute signature and acceptance of the operations carried out.
The seller will communicate by email confirmation of the registered order.
Failure to pay all or part of the order would automatically and without formality result in the temporary cancellation of the order. In this case, LA Mon Make Up will contact the customer to rectify the situation. According to law n°80.335, the goods sent to the customer remain the full property of the Mon Make Up store until full payment has been confirmed.

Withdrawal

Buyers, non-professional individuals, benefit from a withdrawal period of seven days from the delivery of their order to return the product unopened and in perfect condition (for perfumes in particular, no returns will be made on tested items, whose pump has been primed or whose packaging has been unsealed. The return to the seller for exchange or refund will then be made without penalty, with the exception of the return costs which will remain the responsibility of the customer (pursuant to article L. 121-20).

Sales

Items sold on sale will not be returned, exchanged or refunded.

Payment Terms

The price is payable upon ordering.
Payments will be made by credit card; they will be carried out through the secure Paybox system of the Crédit Agricole bank which uses the 3D Secure protocol so that the information transmitted is encrypted by software and no third party can read it during transport on the network.

Stock and restocking

In the exceptional case where the ordered merchandise is not in stock, Mon Make Up will restock the ordered product. The order will then be shipped upon receipt of the products. Except in cases where restocking is not possible, no refund will be made.

Deliveries

Deliveries are made to the address indicated in the order form which can only be in the agreed geographical area.
The risks are the responsibility of the purchaser from the moment the products leave the premises of Mon Make Up. In the event of damage during transport, a reasoned protest must be made to the carrier within three days of delivery.

Transport delay

The delivery times indicated on the site are the delivery times indicated by the Post Office services (Colissimo and Chronopost).
These contractual deadlines may be extended for any reason that has made it impossible for the seller to fulfill its obligations, in particular in the event of force majeure within the meaning of Article 1148 of the Civil Code (strikes, accidents, war, natural disasters, events over which the seller cannot reasonably control). A delay in delivery may in no case justify the cancellation of the order.

Guarantee

All products supplied by the seller benefit from the legal guarantee provided for by articles 1641 et seq. of the Civil Code.
In the event of non-conformity of a product sold, it may be returned to the seller who will take it back, exchange it or refund it.

Responsibility

The seller, in the online sales process, is only bound by an obligation of means; his liability cannot be incurred for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, interruption of service, or other involuntary problems.

Intellectual property

All elements of the Mon Make Up site are and remain the intellectual and exclusive property of Mon Make Up.
No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site whether software, visual or audio.
Any simple or hypertext link is strictly prohibited without the express written consent of Mon Make Up.

Personal data

In accordance with the law relating to information technology, files and freedoms of January 6, 1978, personal information relating to buyers may be subject to automated processing.
Mon Make Up reserves the right to collect information about buyers including by using cookies.
Buyers may object to the disclosure of their contact details by reporting this to Mon Make Up. Similarly, users have the right to access and rectify data concerning them, in accordance with the law of 6 January 1978.

Archiving

Mon Make Up will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the Civil Code.

Dispute Resolution

These online sales conditions are subject to French law. In the event of a dispute, jurisdiction is assigned to the competent courts of ANNECY, notwithstanding multiple defendants or third-party claims.
